DUTIES, AUTHORITIES AND RESPONSIBILITIES OF THE METROPOLITAN MUNICIPALITY
The Duties, Authorities and Responsibilities of the Metropolitan Municipality are as follows;
a) To prepare the strategic plan, annual targets, investment programs and budget of the metropolitan municipality by taking the opinions of the district and first-tier municipalities.
b) To prepare, have it made and to approve and implement a master development plan at any scale between 1/5,000 and 1/25,000 within the boundaries of the metropolitan municipality and adjacent areas, provided that it is in accordance with the environmental plan; to approve the implementation development plans to be prepared by the municipalities in the metropolitan area in accordance with the master plan, the changes to be made in these plans, the parceling plans and the development improvement plans as they are or by changing them, and to supervise their implementation; To make or have the implementation zoning plans and subdivision plans of the district and first stage municipalities that do not make the implementation zoning plans and parceling plans within one year following the effective date of the master zoning plan.
c) To make and license zoning plans of all scales, subdivision plans and all kinds of zoning applications related to the projects, construction, maintenance and repair works required by the duties and services given to the metropolitan municipality by laws, and to use the authorities given to the municipalities in the Slum Law No. 775 of 20.7.1966.
d) To give licenses to the workplaces in the areas built or operated by the metropolitan municipality and to inspect the places to be operated in the areas under the responsibility of the metropolitan municipality.
e) To use the powers set forth in Articles 69 and 73 of the Municipal Law.
f) To make or have the metropolitan transportation master plan made and to implement it; planning and coordinating transportation and public transportation services; to determine the number of taxis, ticket prices and tariffs, times and routes of all kinds of services and public transportation vehicles operated on land, sea, water and railway; to identify and operate, operate or lease the parking areas on the stopping places and on the highway, road, avenue, street, square and similar places; To carry out all the works required by the traffic regulation given to the municipalities by the laws.
g) To construct squares, boulevards, avenues and main roads within the jurisdiction of the metropolitan municipality, to have them built, to maintain and repair them, to impose obligations on buildings that have facades to these places in accordance with urban design projects; to determine the places where notices and advertisements will be hung and their shape and size; To carry out the works of assigning the names and numbers of squares, boulevards, streets, roads and streets, and numbering the buildings on them.
h) To establish geographic and urban information systems.
i) To ensure the protection of the environment, agricultural areas and water basins in accordance with the principle of sustainable development; afforestation ( Phrase Added with Article 85/d of Law No. 5393 Published in the Official Gazette dated 13/07/2005 and numbered 25874); to gather in certain parts of the city for non-sanitary works, places of entertainment, public health and other workplaces that have an impact on the environment; determining construction materials, scrap storage areas and sales places, excavation soil, rubble, sand and gravel storage areas, wood and coal sales and storage areas, and taking measures that will not cause environmental pollution in their transportation; to make and have the metropolitan solid waste management plan made; Re-evaluation of solid wastes and excavations, excluding collection of solid wastes at the source and transporting them to the transfer station, to perform services related to its storage and disposal, to establish facilities for this purpose, to have them installed, to operate or to have them operated; to carry out services related to industrial and medical wastes, to establish the necessary facilities for this, to have them installed, to operate or to have them operated; collecting, collecting, purifying the wastes of marine vehicles and making the necessary arrangements.
j) To license and supervise first class non-sanitary establishments, including those related to food, and to establish and operate laboratories to analyze food and beverage materials.
k) To perform municipal police services in areas where the metropolitan municipality is authorized or operated.
l) To build passenger and freight terminals, indoor and outdoor car parks, to have them built, to operate, to have them operated or to give licenses.
m) To build, have, operate or have the social facilities, regional parks, zoos, animal shelters, libraries, museums, sports, recreation, entertainment and similar places that serve the integrity of the metropolitan built or operated; to provide materials and support to amateur sports clubs when necessary, to organize sports competitions between amateur teams, to award athletes who have excelled or won degrees in domestic and international competitions, by the decision of the city council.
n) To construct buildings and facilities for health, education and cultural services when necessary, to carry out all kinds of maintenance and repair of buildings and facilities related to these services belonging to public institutions and organizations, and to provide necessary material support.
o) To ensure the preservation of cultural and natural assets, historical texture and places and functions that are important in terms of urban history, to carry out maintenance and repair for this purpose, and to rebuild those that cannot be preserved in accordance with their original form.
p) To carry out public transportation services within the metropolitan area and to establish, have them set up, operate or have them operated for this purpose, to give licenses to public transportation vehicles, including taxis and service vehicles, in the land and sea within the metropolitan borders.
r) To carry out water and sewerage services, to establish dams and other facilities necessary for this, to have them installed and operated; reclamation of streams; marketing spring water or water produced at the end of treatment.
s) To identify cemeteries, to establish cemeteries, to operate, to have them operated, to carry out services related to burial.
t) To build, have, operate or have them run all kinds of wholesale markets and slaughterhouses, to license and supervise the special markets and slaughterhouses to be built in the places indicated in the zoning plan.
u) To make plans and other preparations related to natural disasters at the metropolitan scale in accordance with the plans made at the provincial level; providing tools, equipment and material support to other disaster areas when necessary; conducting fire and emergency services; to detect explosive and flammable material production and storage areas, to inspect residences, workplaces, entertainment venues, factories and industrial establishments and public institutions in terms of precautions to be taken against fire and other disasters, to issue permits and licenses required by the legislation in this regard.
v) To carry out and develop health centers, hospitals, mobile health units and all kinds of social and cultural services for adults, the elderly, the disabled, women, youth and children, to establish social facilities for this purpose, to open vocational and skill training courses, to operate or have them operated, To cooperate with universities, high schools, vocational high schools, public institutions and non-governmental organizations while carrying out these services.
y) Establishing, installing, operating or having central heating systems installed.
z) Evacuating and demolishing buildings that are at risk of disaster or that pose a danger to life and property safety.
Metropolitan municipalities are obliged to use their powers specified in subparagraph (c) of the first paragraph in accordance with the zoning plans and notify the relevant municipality. Metropolitan municipalities can transfer any of these duties they deem appropriate to the district and first-tier municipalities with the decision of the city council, and they can do it together.
